Terms of use for ihandpan.com — what you may do with the lessons, guides and Study answers, and the limits of what the site offers.

Who publishes this site #

https://www.ihandpan.com is published by Earthas DNCS OÜ, a private limited company registered in Estonia under company number 17406676, registered office Narva mnt 5, Kesklinna linnaosa, Tallinn 10117, Harju maakond, trading as Ibi Malik. In these terms, “we” and “us” mean Earthas DNCS OÜ.

What this site is #

A free resource for learning the handpan: a step-by-step course of lessons, my guides to choosing and buying an instrument, and a Study section answering questions about the handpan, its history, its music and how to look after it. It is not a shop, there is nothing to pay for, and nothing on it is an offer to sell you anything.

Nothing on this site is professional advice. Some answers touch on health (sore hands, hearing, posture), money (prices, deposits, scams, insurance), travel and customs rules, or the law (trademarks, selling and shipping). They are general information, written in good faith, and they can be incomplete or go out of date — prices especially. Before relying on them, check with a doctor, a financial or legal adviser, your airline or customs authority, or the maker or seller concerned, as the case may be.

Playing an instrument is physical. Warm up, take breaks, and stop if something hurts. You practise at your own risk.

What you may do with the content #

The words on this site — the lessons, the guides and the Study answers — are licensed under the Creative Commons Attribution 4.0 International licence (CC BY 4.0). You may copy, share, translate and adapt them, for any purpose, provided you credit them to ihandpan.com, by Ibi Malik, link to the page they came from, and say if you changed them. The licence itself sets out the full terms.

Everything else — the photographs, the videos, the logo and the design of the site — is owned by us or used with permission, is protected by copyright and other laws of Estonia, the European Union and other countries, and is not covered by that licence. You are welcome to:

  • read, watch and practise from anything on the site, for free, without an account;
  • link to any page here;
  • print or save any page for your own study; and
  • share the videos through the links and share buttons YouTube provides.

What you may not do #

Without our written permission, please do not:

  • copy, republish, redistribute or mirror the photographs or the videos, in whole or in part, anywhere;
  • use the photographs, videos or logo commercially, including in paid courses, in advertising or in any product or service;
  • remove the attribution from anything you reuse, pass our work off as your own, or imply that we endorse you; or
  • use automated means in a way that places an unreasonable load on the site.

Text and data mining of the photographs and videos is expressly reserved. We reserve all rights in them for the purposes of text and data mining, including for training or developing artificial intelligence or machine learning systems, under Article 4(3) of Directive (EU) 2019/790 and any equivalent provision elsewhere.

Names and logos #

“Earthas DNCS OÜ”, “Ibi Malik”, “ihandpan.com” and our logo are ours. Except as set out above, you may not use them, alone or with other words or designs, in any press release, advertisement, or promotional or marketing material, in any medium.

The site names many handpan makers, brands, shops, teachers and players. Their names and marks — including Hang, a registered trademark of PANArt — appear for identification only. That does not mean they endorse the site or anything on it, or that we endorse them, and these terms give you no right to use their marks. Nothing on the site is sponsored, and it contains no affiliate links.

Your privacy #

We handle personal data as described in our privacy policy, which forms part of these terms. In short: this site sets no cookies, runs no analytics, and asks you for nothing.

Accessibility #

We want the site to be usable by as many people as possible. Where it currently falls short, and how to tell us about a problem, is set out in the accessibility statement.

The site is provided as it is #

We take care over what is published here, but the site is provided as it is and as available. We make no representations or warranties about it, express or implied. In particular we do not warrant that it will be uninterrupted, error-free, secure, or free from viruses or malicious code, or that anything on it is complete, accurate or up to date. To the fullest extent the law allows, we exclude the implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, compatibility, security and accuracy.

Limits on our liability #

To the fullest extent permitted by law, we are not liable for any indirect, special, incidental, consequential or punitive damages, or for any loss of data, profit, business or goodwill, arising out of or relating to your use of this site, whether the claim is made in contract, tort (including negligence), under statute or otherwise, and even if we knew such loss was possible. That includes any decision to buy, sell or ship an instrument.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. If you are a consumer, these terms do not affect your statutory rights.

Some links lead to websites, resources and tools run by other people, including handpan makers and sellers. We have no control over them, make no representations or warranties about them, and a link is not an endorsement of the site, its contents or its instruments.

If part of these terms does not hold #

If any part of these terms is found invalid or unenforceable in a country, it is to be read as narrowly as needed to make it valid there while keeping its intent, and the rest of the terms continue in full force — in that country and everywhere else.

A delay in enforcing any part of these terms is not a waiver of it.

Changes to these terms #

We may revise these terms by posting the revised version on this page. The date at the top is when they last changed. Revisions take effect when posted, and continuing to use the site means you accept them. A revision does not take back the CC BY 4.0 licence for words already published under it.

Governing law #

These terms are governed by the law of Estonia and of the European Union. Disputes arising out of or in connection with them are subject to the jurisdiction of the Estonian courts. If you are a consumer resident elsewhere in the EU, this does not deprive you of the protection of the mandatory law of your own country.
